Description

Ordinance to amend Chapter 3.08 “beer and liquor control” of the 2015 municipal code, by amending section 3.08.190 “prohibited sales and acts” by replacing paragraph (7) with a new paragraph (7). 
Background/Discussion

These ordinances are being proposed to allow events such as bike night on the 100 block without needing to get a special liquor license.  

It will also eliminate the fencing requirements between the street and the sidewalks.  The liquor license establishments will be able to sell beer and wine to patrons who could then carry those open containers out onto the sidewalk and street during the hours of the event.  

The patrons would not be permitted to leave the Special Event Area with the open container unless they would reenter the establishment they had purchased the drink from.  

As these events applications come forward and if they would include portions of a street, the city council would have to take an additional action of temporarily vacating the portion of the street to be included.  This is necessary to keep the event compliant with state law. 
 
Recommendation

Jodi Quakenbush, Timothy Carmody and other Police Staff met with the organizers of "Bike Night on the 100 Block"  We Asked Richard Wade to prepare this ordinance to address some of the concerns & issues the organization had last year and to help with the anticipated growth of the upcoming year.
